Michigan’s highest court rejected a bid to remove Trump from the 2024 primary ballot, alleging a violation of a section of the Constitution.
The Michigan Supreme Court has rejected a proposal to remove former President Donald Trump from the state’s primary ballot in 2024.
The court’s decision blocks attempts to remove Donald Trump from the 2024 ballot in Michigan. This is based on Section 3 of the 14th Amendment, which prohibits individuals engaged in insurrection or rebellion after swearing an oath to support the Constitution from holding office.
On Wednesday, the court swiftly rejected a case seeking to exclude Trump from Michigan’s ballot. They stated they’re “not persuaded that the questions presented should be reviewed by this court.”
The court’s ruling follows a similar decision by the Michigan Court of Appeals, which rejected challenges to Trump’s presence on the state’s primary ballot. The appellate court, in a unanimous 3-0 opinion, stated, “Decisions about who appears on the primary ballot are made by the political parties and individual candidates.”
Courts in Arizona and Minnesota have also dismissed attempts to bar Trump from the ballot. The Minnesota Supreme Court rejected a petition by voters seeking to keep Trump off the 2024 GOP primary and general election ballots, stating that Minnesota law allows major parties to include even ineligible candidates on the primary ballot.
The Michigan Supreme Court’s decision on Wednesday differs from the recent ruling in Colorado. Last week, the Colorado Supreme Court made a distinctive decision, blocking Trump’s candidacy in the state’s primary next year based on constitutional grounds.
In Colorado, the court stated, “A majority of us believe that President Trump cannot hold the office of President under Section Three of the Fourteenth Amendment of the United States Constitution. Because of this disqualification, it would be against the Election Code for the Colorado Secretary of State to include him as a candidate on the presidential primary ballot.”
Trump expressed approval for the Michigan Supreme Court’s decision on his Truth Social platform. He stated that the court rightly denied a “Desperate Democrat attempt” to remove him from the 2024 Presidential Election ballot in Michigan. Trump described the attempt as a “pathetic gambit” that failed nationwide, except in Colorado.
